NOTICE OF SALE
NOTICE IS HEREBY GIVEN that on September 16, 2026, at the hour of 12:30 PM, the undersigned Special Master, or his designee, will, at the front entrance of the McKinley County Courthouse, at 207 West Hill Street, Gallup, NM 87301, sell all of the rights, title, and interests of the above-named Defendants, in and to the hereinafter described real property to the highest bidder for cash. The property to be sold is located at 31 Sagar Dr., Vanderwagen, New Mexico 87326, and is more particularly described as follows:
Lot Thirty (30) in SAGAR ESTATES SUBDIVISION, as the same is shown and designated on the Plat of said subdivision filed for record on November 19, 1987,
including any improvements, fixtures, and attachments, such as, but not limited to, mobile homes (hereinafter the “Property”). If there is a conflict between the legal description and the street address, the legal description shall control.
The foregoing sale will be made to satisfy a foreclosure judgment rendered by this Court in the above-entitled and numbered cause on June 25, 2026, being an action to foreclose a mortgage on the Property. Plaintiff’s judgment is in the amount of $222,765.46, and the same bears interest at the rate of 3.6250% per annum, accruing at the rate of $22.12 per diem. The Court reserves entry of final judgment against Defendant, Victoria Wilson, for the amount due after foreclosure sale, including interest, costs, and fees as may be assessed by the Court. Plaintiff has the right to bid at the foregoing sale in an amount equal to its judgment, and to submit its bid either verbally or in writing. Plaintiff may apply all or any part of its judgment to the purchase price in lieu of cash.
In accordance with the Court’s decree, the proceeds of sale are to be applied first to the costs of sale, including the Special Master’s fees, and then to satisfy the above-described judgment, including interest, with any remaining balance to be paid unto the registry of the Court in order to satisfy any future adjudication of priority lienholders.
NOTICE IS FURTHER GIVEN that in the event that the subject Note and Mortgage is not sooner paid off or reinstated, the undersigned Special Master will, as set forth above, offer for sale and sell the Property to the highest bidder for cash or equivalent, for the purpose of satisfying, in the adjudged order of priorities, the judgment and decree of foreclosure described herein, together with any additional costs and attorney’s fees, including the costs of advertisement and publication for the foregoing sale, and, reasonable receiver and Special Master’s fees in an amount to be fixed by the Court. The amount of the judgment due is $222,765.46, plus interest to and including date of sale in the amount of $3,074.68, for a total judgment of $225,840.14.
The foregoing sale may be postponed and rescheduled at the discretion of the Special Master, and is subject to all taxes, utility liens and other restrictions and easements of record, and subject to a one (1) month right of redemption held by the Defendants upon entry of an order approving sale, and subject to the entry of an order of the Court approving the terms and conditions of sale.

NOTICE is hereby given that on May 26, 2025, and on June 16, 2025, applicants Quirino Ramirez and Marcelina Sanchez de Ramirez, 27 E Coolidge Road, Continental Divide, NM 87312, filed Application No. G-03382-1 with the STATE ENGINEER for permit to Appropriate Groundwater in the Gallup Underground Water Basin of the State of New Mexico.
McKinley is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Gallup Sun.
The applicant proposes to appropriate 1.00 acre-feet per annum, consumptive use, from existing well G-03382 POD1, located at a point where latitude = 35.444894° N and longitude = 108.358557° W, to be used for commercial and cannabis purposes, within 0.50 acres of land described as part of Tract 1 and part of the SW ¼ SE ¼ SW ¼ NE ¼ of Section 18, Township 14 North, Range 14 West. The point of diversion and place of use are owned by Quirino Ramirez and Marcelina Sanchez de Ramirez and are further described as being located about 140 ft. north of a point on East Coolidge Road about 0.61 mi. east on East Coolidge Road from the intersection of the overpass of westbound Exit 47 from I-40 and East Coolidge Road.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment, if impairment you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM, 87109, on or before Thursday, September 10, 2026. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmarks will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.

Further, if any of these conditions exist, at the time of sale, this sale will be null and void, the successful bidder’s funds shall be returned, and the Special Master and the mortgagee giving this notice shall not be liable to the successful bidder for any damages.
NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. Plaintiff and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.
