Aggravated DWI (Third)
New Mexico State Police pulled over a vehicle for speeding and eventually arrested a Tohatchi man for his third DWI.
Officer Joe Roanhorse was monitoring traffic on U.S. Highway 491 near milepost 4 when he observed a 2007 Buick LaCross traveling northbound about 70 mph in a posted 55-mph zone.
Roanhorse turned and followed the vehicle, which soon pulled into the Gas Max station at 516 U.S. Highway 491. He met the driver, Miles Bitsoi, 41, and began questioning him. The vehicle had an expired registration dating to January and no active insurance.
Bitsoi reportedly showed signs of intoxication including bloodshot eyes, slurred speech, and smelling of alcohol. He also reportedly admitted to drinking an unspecified amount of alcohol prior to driving.
Roanhorse then administered the Standard Field Sobriety Tests. However, Bitsoi performed poorly, was deemed incapable of safely operating the vehicle, and placed under arrest.
During an inventory of the vehicle before it was towed, Roanhorse reportedly found an empty, open 23.5-ounce can of Mike’s Harder Lemonade on the rear floorboard.
At the local state police office, Bitsoi agreed to the breath test. He posted two samples of .20. Then a records check showed Bitsoi had two prior DWI arrests.
Once the paperwork was complete, Roanhorse transported Bitsoi to the McKinley County Adult Detention Center, where he was booked for aggravated DWI (third), speeding, expired registration, no insurance, and open container.
His pretrial hearing is set for Oct. 8.
