Aggravated DWI (Second)
A Church Rock woman was pulled over for swerving her vehicle across the road and eventually arrested and charged for her second DWI.
McKinley County Sheriff’s Deputy Ernesto Giron was working the DWI Task Force on Highway 602. He located and stopped a gray Ford F-150 that matched the description of a reckless driver call sent earlier. Prior to pulling off near mile marker 27, the vehicle reportedly continued to swerve in and out of the southbound lane and over the solid white line.
Giron met the driver, Wynice Montoya-Franklin, 43, and began questioning her. Montoya-Franklin reportedly showed signs of impairment including bloodshot eyes, slurred speech, and smelling of alcohol. She also reportedly admitted to drinking an unspecified amount and type of alcohol prior to driving.
After exiting the vehicle on command, Montoya-Franklin reportedly had trouble maintaining her balance, but she agreed to take the Standard Field Sobriety Tests. However, she performed poorly on the tests and was placed under arrest. Giron searched the vehicle afterward and reportedly located one small open container of Yukon Jack in the front seat.
Montoya-Franklin agreed to the breath test after being taken to the sheriff’s office. She posted two samples of .19. After the paperwork was finished, she was taken to the McKinley County Adult Detention Center and booked for aggravated DWI (second), failure to maintain lane, and open container.
Her pretrial hearing is set for Aug. 25.
