Aggravated DWI
Gallup Police arrested a Vanderwagen man for a reckless driving case which led to a DUI investigation and the discovery of a firearm in his vehicle.
Metro Dispatch was advised of a speeding blue Chevrolet pickup truck near the UPS Store at 2418 E. Hwy. 66. The caller stated that the suspect vehicle, which displayed an “Alaskan” decal, had struck a broken-down truck before fleeing southbound towards NCI on Boardman Drive.
Officer Warren Bowannie located the truck several minutes later on Boardman, where he observed the driver making several dangerous maneuvers, including an illegal U-turn near the Gallup Aquatic Center at 620 Boardman Dr. When he attempted to make a traffic stop, the driver refused to comply, driving over curbs and through a parking lot before finally stopping in the Magistrate Court parking lot at 285 Boardman Dr.
Bowannie was joined by other officers at the scene where they met the driver, David Shafer. He reportedly appeared visibly intoxicated and uncooperative, and the officers noted a strong smell of alcohol from his person along with his staggering and bloodshot eyes. Shafer admitted to consuming two beers and three shots at Rocket Cafe earlier in the evening.
The officers searched his vehicle and located a loaded 9mm Smith & Wesson Walther P99 firearm, which was found in plain view. The firearm was safely secured while Shafer took the Standard Field Sobriety Tests, which he failed.
Based on the investigation, Shafer was placed under arrest. He refused to give a breath sample and was eventually taken to the McKinley County Adult Detention Center and booked for negligent use of a firearm and driving while intoxicated. His pretrial hearing is set for March 20.
