Aggravated DWI (Third)
New Mexico State Police pulled over a vehicle that nearly ran into one of their units and eventually arrested a Continental Divide man for his third DWI.
Officer Brandi Garnanez was traveling eastbound on Interstate 40 near mile marker 28 when she observed a black Ford F-150 struggling to maintain its lane. The truck nearly collided with Garnanez’s unit, so she slowed down and activated her unit’s emergency lights to initiate a traffic stop. The truck also reportedly had trouble pulling over.
Afterward, Garanez met the driver, Shawn Tsosie, 49, who reportedly showed signs of intoxication including bloodshot eyes, slurred speech, smelling of alcohol, and seeming confused as he spoke. Tsosie exited the vehicle on command, during which he reportedly admitted to drinking a can of Steel Reserve 211 about two hours prior to driving.
Tsosie agreed to take the Standard Field Sobriety Tests. However, he performed poorly on the tests and was placed under arrest. He refused to give a breath sample afterward. Once the paperwork was completed, Tsosie was taken to the McKinley County Adult Detention Center and booked for aggravated DWI (third).
His pretrial hearing is set for May 19.
