Aggravated DWI (Third)
New Mexico State Police stopped a Fort Wingate man for speeding and eventually arrested him for driving with a revoked license on top of a third DWI charge.
Officer Irvonne Bahe was patrolling State Highway 118 when he clocked a gray Nissan Sentra traveling westbound 76 mph in a 55-mph zone. Bahe turned his unit around to follow the vehicle as it merged onto Interstate 40, where Bahe initiated a traffic stop near mile marker 33.
Bahe met the driver, Mika Jon Lowley, 35, who reportedly presented only a photocopy of an expired state ID. As he spoke to him, Bahe observed Lowley reportedly show signs of intoxication including smelling strongly of alcohol, bloodshot eyes, and slurred speech.
Lowley agreed to take the Standard Field Sobriety Tests and denied consuming any alcohol prior to driving. However, he performed poorly on the tests and was then placed under arrest. Lowley became aggressive and refused to provide breath samples both at the scene and later at the Gallup State Police station.
After the processing was completed, Lowley was transported and booked into the McKinley County Detention Center for aggravated DWI (third) and driving with a revoked license. His pretrial hearing is set for Aug. 28
