Aggravated DWI (Third)
New Mexico State Police stopped a speeding vehicle and eventually arrested a Gamerco man for his third DWI.
Officer Terence Willie was patrolling southbound on Munoz Overpass when he observed a black Cadillac CTS traveling northbound. His unit’s radar clocked it at a speed of 61 mph in a 40-mph zone, so he turned and followed the vehicle. It pulled over near the intersection of U.S. Highway 491 and Maloney Avenue, where Willie conducted a traffic stop.
He met the driver, Michael Guerrero, 49, who stated he was driving around and taking his friend in the vehicle home to the north side of Gallup. Guerrero reportedly showed signs of intoxication including bloodshot eyes and smelling of alcohol. He also reportedly said he drank two shots of tequila about 45 minutes prior to driving.
Willie administered the Standard Field Sobriety Tests to Guerrero. However, Guerrero performed poorly on the tests and was placed under arrest. He refused to give a breath sample. A search of the vehicle showed a container of Crown Royal with its seal broken.
Once the paperwork was completed, Guerrero was transported to McKinley County Adult Detention Center and booked for aggravated DWI (third), speeding over 21-25 and open container. His pretrial hearing is set for March 24.
