DWI, Speeding
New Mexico State Police officers stopped a vehicle traveling about 20 mph over the speed limit and eventually arrested the Gallup driver for a DWI.
Deputy Terence Willie was on patrol on Highway 118 near milepost 24 when he observed a gold Chevrolet Nova traveling about 67 mph in a 45-mph zone. After clocking the speed on his unit’s radar, he turned around to follow the vehicle. The suspect vehicle soon pulled into the parking lot of the Blake’s Lotaburger at 2666 E. Hwy. 118.
Willie met the driver, Sidney Davis, 25, who stated that he and a passenger were traveling from and going back home. He only produced a valid driver’s license when asked for his identification. As he spoke, Davis reportedly showed signs of intoxication including bloodshot eyes and smelling of alcohol.
Davis denied drinking anything prior to driving, and reportedly answered “I don’t know” when asked why he smelled of alcohol. Willie administered the Standard Field Sobriety Tests, but Davis performed poorly on them and was placed under arrest. A search of the vehicle revealed multiple miniature bottles of 99 Black Cherry.
Willie transported Davis to the local state police office for the breath test, where Davis posted samples of .13 and .12. Once the paperwork was completed, Willie then transported Davis to McKinley County Adult Detention Center, where he was booked for DWI, speeding (over 15-20 mph), no registration or insurance, and open container.
His pretrial hearing is set for March 19.
